Molsons Strike

Excuse me but this is 2007 and the economy is booming. So why the claw back mentality of the past? Because Alberta has the weakest labour laws in Canada encouraging employers to be assholes.

Claw backs began in Alberta a decade ago when King Ralph pushed privatization and used the debt and deficit hysteria to punish public sector workers with claw backs in wages and benefits, which had been prompted by Safeway's claw back bargaining with UFCW across North America.

Class war was declared by Safeways and other employers beginning in the eighties prompted by the anti-union attacks of the neo-conservative regimes of Reagan, Thatcher, and Mulroney. It continued for over a decade across North America, as Kim Moody documented in his book an Injury to All.

Today with a provincial labour shortage, low interest rates, increased stock prices and productivity, Molsons Coors wants to go back to the past.

Todd Romanow, national representative for the Canadian Auto Workers union, accused Molson of stubbornly insisting on rolling back wages and pensions to 1980 levels for new employees.

"Beer is supposed to be for happy times, right now it is not," said Dave Wilton, picket captain with the Local 284 Canadian Auto Workers.

Employees, like Wilton, are ticked off that wages of future hires are rolled back from $29 to $22 an hour.

And while company spokesman Ferg Devins said the rollback is still competitive within the Alberta market, Wilton doesn't agree because he said the company is making a lot of profit.

The contract would also pass on some of the pension costs in a "defined contribution" of 3% of annual salary by new workers, and cut sick days of all employees from nine to six.

With the current hot Alberta economy, anyone getting paid at the proposed new rate won't be able to afford decent housing in Edmonton, he said.

Meanwhile in Calgary the climate change denying CEO of controversial Talisman Energy retires with a golden parachute.

Mr. Buckee retires with fantastic wealth, having cashed in stock options worth $24-million in 2005 and 2006. The rest of his options were valued at $52-million, as of Dec. 31, along with a $1.4-million annual pension whose total value is pegged at $23-million.


So who says class war is a thing of the past.


With the onset of the crisis, Moody's narrative becomes largely the bleak account of an even bleaker reality. He describes all the strategies devised by capital to impose the new rules on American workers: the dispersion of production to smaller units around the U.S., direct investment in production abroad, the "outsourcing" of work overseas, concentration (forcing small, isolated plants to confront big conglomerates with many sources of revenue), and the breakup of "pattern bargaining" on an industry-wide scale. By the late 1970's, business was also engaged in a new political activism capable of defeating pro-labor legislation in a Democratic congress and which, by pressure on the future "Reagan Democrats", helped to set the Reagan agenda even before Reagan. Because the UAW was the very model of postwar business unionism, Moody rightly underscores the Chrysler bailout of 1979-80 as a major turning point. To save Chrysler fom bankrupcty, the UAW made a series of concessions in exchange for such dubious benefits as a seat for union president Doug Fraser on Chrysler's board of directors. Whereas Fraser had, in 1978, denounced the "one-sided class war" being waged by business on working people, he and other labor leaders hailed this contract as a "breakthrough". It WAS a breakthrough-- for management. By the early 1980's, the precedent of the Chrysler contract had opened the floodgates for a "tidal wave of concessions" everywhere. Even companies with no apparent squeeze on their profits sensed the new balance of forces and demanded, usually successfully, the renegotiation of unexpired contracts, obtaining major concessions on wages, benefits and work rules. It was the biggest rollback for U.S. labor since the post-1929 Depression years, and it is not over. As Moody points out, the "realism" of business unionism faced with demands for concessions does not even achieve its minimum stated goal of saving jobs.

Business was way ahead of both the "business unionists" and the rank- and- file in taking advantage of the new situation. Even today, when the depth of the crisis has impressed itself on nearly everyone in both camps of capital and labor, the business unionists cling to the discredited practice of a bygone era. They have shown aggressiveness and imagination only in combating rank-and-file attempts, such as the P-9 strike in Austin, Minnesota, to break out of the suicidical "business as usual" mentality of mainstream organized labor. They have responded to the weakening of unions by complaceny, by organizing the limited constituency of middle-class service workers, by intimidation of rank-and-file insurgents, or by formless mergers of unions with little in common as a bargaining unit. Confronted with the challenge to organize the vast new proletariat in dead-end and low-paying service jobs, business unionists react wth the same condescension and lethargy that the bureaucrats of the AFL showed toward tthe unorganized mass of production workers in the 1930's, prior to the rise of the CIO.

Alberta's Padrone Culture


While unions in Alberta have opposed the exploitation of foreign workers which is being promoted by oil companies and their pals in the provincial and federal governments it is also the unions that are fighting for these workers rights.

Exploitation of foreign workers is rife in the free wheeling padrone culture of Alberta.

An advocate for Alberta's temporary foreign workers says her phone is ringing off the hook with people who say they're being treated unfairly by their bosses.

They came for a brief taste of the Alberta Advantage, with each man saying he paid $6,000 to $12,000 up front for a chance to ply his trade for a better wage.

But they wound up with no job, their money gone, crammed 15 to a house in Mill Woods, with no legal right to work in Canada. They had no promise of help getting home and demands from their work agent for even more money, they say.

The agency, Worldwide Workforce, says the men are lying and that the thousands of dollars it did charge went to cover legitimate costs.

In the meantime, two other foreign workers, with a Chinese firm, died on one of the oilpatch projects the East Indian arrivals expected to work on.

Seven of the East Indian men are now working, after residents took them in and introduced them to the International Boilermakers Union, which found them placements with employers who had federal permission to hire temporary foreign workers. Three more may have work soon.

Employment and Immigration and Industry Minister Iris Evans tabled a letter
from Alberta Federation of Labour president Gil McGowan in the Legislature today
as proof that she's doing everything she can to protect the growing number of
foreign workers brought into Alberta under temporary work permits.

But McGowan says all the minister's stunt proves is that she really
doesn't understand how her own department functions and what challenges
temporary workers actually face when they arrive here.
McGowan says there are currently no dedicated mechanisms in place at
either the federal or provincial level to ensure that temporary foreign
workers are being treated fairly by employers. Instead, both governments
simply say temporary workers are covered by the same system of workplace rules
as domestic workers.

"The current complaint driven system is flawed for domestic Canadian
workers - but it's a disaster for temporary foreign workers," says McGowan.
"By falling back on the current system, the Minister is basically admitting
that she's not prepared to do anything to help temporary foreign workers. As a
result, she's helping to create a vast underclass of exploitable workers who
don't have access to the same kind of rights and protections in the workplace
as other workers in Canada."



CALGARY/AM770CHQR - Employment and immigration minister is telling people thinking of moving to the province to stay home unless they have a job and a place to live.
Iris Evans says she doesn't want anyone coming here with unrealistic expectations.
Her comments come as Finance Minister Lyle Oberg pondered tax incentives for developers to get more affordable housing built.
Oberg says his department will be looking at both tax incentives and tax cuts.

Union M&A

I raised this issue last week and Barrie McKenna in todays Globe and Mail questions Mergers and Acquisitions in the labour movement. The alternative to the labour movements version of corporatism is One Big Union. Instead of organizing the unorganized, like Starbucks workers, these old industrial based business unions are organizing for their retirement.

On this May Day - also know as International Workers' Day - it's worth asking the question, why merge at all?

The venture may prove to be a lot less ambitious than advertised. The three unions said they would engage in co-ordinated campaigning on issues such as human and labour rights in Colombia, China and elsewhere, as well as common approaches to contract negotiations with multinational companies.

The barriers to more fundamental transatlantic co-operation are substantial, including different labour laws, political systems and employers.

Nor is it clear how the merger would help overcome the greatest challenge facing organized labour - dwindling membership. The vast majority of workers in all three countries aren't union members. In Canada, just a quarter of the civilian labour force belonged to a union last year, down from nearly 30 per cent at the beginning of the 1990s. The comparable numbers for the United States and Britain are 12 per cent and 28.4 per cent, respectively, and the shares continue to fall every year.

The Steelworkers have bucked the trend, but mainly by swallowing other unions, rather than internal growth. And like many unions, nearly a third of its members are retirees, whose ranks are unlikely to be replenished with new union members.

What is the May Week Labour Arts Festival?

The Edmonton May Week Labour Arts Festival brings together the labour movement, workers and artists to celebrate the achievements of people’s struggles for social and economic justice through visual arts, music, film, poetry and theatre. Through the many artistic disciplines of the festival, May Week provides people with the information, education and inspiration to make positive change in our local and global communities.

The May Week festival is built around May Day (May 1st), which is recognized as the International Workers’ Holiday, chosen over 100 years ago to commemorate the struggles and gains of workers and the Labour Movement. May 1st is also a significant date in the fight for the eight-hour workday, and is tied to the infamous Haymarket Tragedy. May Day is important not only for its historical significance, but also as a time to organize and speak out around issues that are impacting working-class people today.

Global Visions Film Festival

May Week teams up with the Global Visions Film Festival to bring you an evening of short labour films, featuring the Canadian release of “Mother Jones: Americas Most Dangerous Woman”. Directed by Laura Vasquez and Rosemary Feurer, this short documentary celebrates the life and times of this revolutionary labour organizer and activist.

Also showing by the same directors is Lockout 484, which profiles the 2005 struggle of workers in Meredosia, Illinois, against a global conglomerate, the Celanese Corporation. Workers were locked out when they refused to take 33% wage cuts and eliminate whole divisions. The film illustrates their belief in and commitment to the union, and the effect of the lockout on their community.

Why Managers Need Unions

Managers' overtime victory short-lived

Manitoba quickly closes loophole that handed supervisor a win

The hopes of overworked managers everywhere were briefly raised yesterday when a scrappy former store supervisor from Winnipeg won a victory at the Supreme Court of Canada in her fight for overtime pay.

Before they could even think about collecting countless hours of back pay, however, it became apparent to even the most sleep-deprived manager that the window of opportunity opened by the ruling is about to slam shut.

Effective April 30, the Manitoba government will fall in line with all other Canadian jurisdictions and exempt management employees from overtime-pay provisions in their labour laws.

Sharon Michalowski will bank more than $10,000 in overtime pay she has been battling to get from Nygard International Ltd. since 2003. She says her protracted fight has made her the "the poster girl" for other managers who hoped her case would set a precedent.

Even before the Nygard case had worked its way through the courts, employers in Manitoba -- alarmed by the possible implications -- persuaded the provincial government that managers are generally paid better than other employees, have more power to set their own working conditions and, therefore, should not qualify for overtime pay.

Yeah right they are as exploited as the rest of the employees. Managers need to be unionized with the rest of the workers in a shop. The NDP government should be ashamed of itself for being sucked into this claptrap from the bosses. The difference between a Manager and the rest of the workers in most shops is the colour of their shirts, or that they have to wear a tie. Power to set their own working conditions, yeah right....which means that instead of being paid for Overtime they are owed they can flex their work hours, but of course that never really happens at all, instead they just accrue and accrue more unpaid OT. And if they get time off its at straight time, and at the bosses convenience.

This law will be the New Deal of the 21st century if it is passed.

Employee Free Choice Act Hearings Begin in Congress

But the right wing is mobilizing to oppose it.

"Under current law, an employer can already agree to collective bargaining with the union on behalf of his workers when a majority of them have signed union authorization cards. But if the employer wants to make sure that his workers weren't pressured into signing the cards, or if he wants to try to convince them that they will have more flexibility without a union or even that the union may end up destroying jobs, he can insist on an open campaign period followed by a secret ballot election.

The new bill, on the other hand, would force the employer to recognize the union solely on the basis of cards collected by union organizers, collected before the employer even has a chance to make his case to the employees".

Linda Chavez is president of Stop Union Political Abuse.


Linda Chavez is a former Bush appointed Secretary of Labor. What a friend the bosses have in Linda. And like a reformed smoker there is nothing worse than a former union porkchopper and labor fakir, that is someone who has been appointed a union bureaucrat and not elected by the members. Such was Chavez's role in the American Federation of Teachers. Now she attacks unions from her position of privilege. Once a labor fakir always a fake unionist.

If employers want to make their case to their workers they would have insured they had good wages, benefits and working conditions, a grievance procedure, profit sharing, etc. etc. But they won't until forced to.

The right wing pro boss lobby in the U.S. is ramped up attacking this new bill as anti democratic. Really. What about the Right To Work laws that the U.S. government passed that even after workers vote to join a union, those opposed don't have to they get to be free riders.

It was the right wing who brought in
the Taft-Hartley Act which limited workers democratic rights and favored the bosses. Since then so called democratic votes have been rigged in favour of the boss. This is the act that Chavez and her ilk defend and claim is the very essence of American free choice and democracy.

That's not choice that's union busting.

Currently, workers do not have “free choice”
when going through the NLRB petition and election process, Sweeney said. Instead, he said, the petition “triggers a bitter, divisive and often lengthy anti-union campaign designed to chill or destroy union support.”

He continued, “The NLRB process may be called an ‘election,’ but it is nothing like any democratic election held in any other part of our society.”


And the argument Chavez and her ilk make that workers are not joining unions because they have no interest in doing so, of course denies the reality that the bosses are anti-union period. They will use any means possible to stop unionization of their companies. And the laws in the U.S. favour the boss not the workers. Thus the so called democratic vote of all workers is rigged in favour of the boss not the unions. It allows the bosses time to organize an anti-union drive.

The idea behind EFCA is simple. Most any American can join a group -- a church group, the PTA at their child's school, or the National Rifle Association -- by signing a card and paying dues. With EFCA, if a majority at a workplace wants to build a union, they sign cards and the employer recognizes their wishes. Negotiations for a labor contract begin soon after.
Hey don't forget the NRA.

And let's look at how the bosses convince workers NOT to vote union.

The University of Illinois at Chicago's Center for Urban Economic Development released a study in December 2005 that found outrageous instances of employer resistance when workers decide to form a union: 30 percent of employers fire pro-union workers; 49 percent of employers threaten to close a worksite when workers try to unionize; 82 percent of employers hire union- busting consultants to fight organizing drives; and 91 percent of employers force employees to attend anti-union meetings one-on-one with supervisors.

But right now tens of millions of workers can't join unions even when they want to. The Bush administration, which is anti-union to its dying breath, controls federal agencies like the National Labor Relations Board, which oversees labor disputes between workers and their bosses.

This means that Bush-appointees don't settle disputes fairly, but automatically favor companies and typically refuse to protect workers' rights.

But even when Bush appointees aren't tipping the scale to hurt workers, the system of arbitration and labor relations always favors the companies. Even when a majority of workers at a shop or business sign union membership saying they want their union to represent them in collective bargaining, companies have the power to refer the dispute to an NLRB election. This referral gives them something like 6 weeks to change the workers' minds.

And they really go to town on the workers. Threats and harassment are all too common. Bosses will even stage mandatory meetings of workers where they feed the workers a lot of anti-union propaganda like claims that unions will either strike or force the shop to close.

Surveys indicate that more than half of all bosses threaten – illegally – to shut down the workplace and move out of the area or country if the workers decide to join a union. As many as 25 percent of workers who are trying to start a union at their workplace are either fired or threatened with being fired – illegally.
In Canada several provinces have this labour legislation in place, including binding mediation on a first contract. The result has been less first contract strikes and union busting.

In Alberta, the only 'Republican' lite province in Canada, we do not have this legislation we are far closer to the American style labour laws. The result has been long drawn out strikes not only for union recognition but for a first contract. If this law passes in the U.S. it will leave Alberta one of last bastions of right wing anti-labour laws in North America.

Nail In The Coffin


This is the final nail in the coffin of so called 'socialism' in China. Which of course was not socialism but state capitalism. A form of capitalism that allows the state to act as the capitalist in an underdeveloped society. Now China will be free to have lots of capitalists, and capital, and to further challenge American Hegemony politically, militarily and economically.


China to Pass Landmark Property Law


China's parliament is set to discuss a landmark property law when it meets in March. Beijing is thus one step closer to approving the newest draft version of the legislation, which has been reworked seven times because of its apparent capitalistic penchant which conflicts with China's socialist orientation.

The law to protect private property has been a political hot potato in China where state ownership still dominates key parts of the economy.
Zhang Weiying, dean of Guanghua School of Management at Peking University, said he believes the bill would pass the parliament.

"The parliament will pass the law. That will be a very important signal," he said in a recent interview.

Zhang said passing the bill will "give more confidence" to China's rising entrepreneurs, who are "crucial" for China's economic development.

"When people have security, they will know what they will get. They will be more motivated to work, make more money and invest," he said.

Zhang said a well-adopted property law can be a tool for a value creation and wealth redistribution.

How U.S. and other global corporations utilize government-controlled unions created by authoritarian nationalist regimes even as they claim to be liquidating the legacy of those regimes in the interest of economic freedom.
