Alaska Appeals Federal Court Decision With Implications For Arctic Refuge Oil Drilling

(Alaska Beacon) — The state of Alaska is asking a federal appeals court to re-examine a district court decisionthat denied the state almost 20,000 acres of potentially oil-rich land
.

On Monday, the Alaska Department of Law filed a notice of appeal to the 9th U.S. Circuit Court of Appeals in an 11-year-old lawsuit that is attempting to fix the location of the western border of the Arctic National Wildlife Refuge.


That border has been disputed between the state and the federal government for decades and matters because the land in the disputed area is believed to contain significant amounts of oil.

“The public land order that created ANWR placed its western boundary on the ‘extreme west bank of the Canning River.’ Despite this clear language, the Bureau of Land Management had placed the boundary on the western bank of a separate and distinct river — the Staines — and the federal court got it wrong too,” the Department of Law said in a statement. “This dispute affects approximately 20,000 acres of Alaska’s lands, which are believed to have valuable oil and gas reserves.”

If the land is not within the refuge, it would still be federally owned but could be selected for eventual transfer to the state.

A ruling in the state’s favor might eventually result in oil and gas drilling that would generate millions of dollars in state and local revenue.

A ruling in the federal government’s favor would either protect the land from development or allow oil and gas development under the federal government’s controversial and legally challenged refuge drilling plan.

The appeal comes less than 30 days after District Court Judge Judge Sharon Gleason entered a judgment against the state and in favor of the federal government.

No schedule has yet been set for proceedings in the circuit court.
